This statement outlines your rights and legal obligations in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016.

This statement also complies with the Act of July 30, 2018, on the protection of natural persons with regard to the processing of personal data, hereinafter referred to as “the Act of July 30, 2018.”

The purpose of this statement is to explain how we handle the personal data you provide to us, why we collect or process this data, and under what circumstances we may disclose it.

This statement will address several concepts:

  • Personal data: any information relating to an identified or identifiable natural or legal person (name, address, email address, cell phone number);
  • Processing: any operation performed on personal data (collection, recording, storage, destruction, etc.);
  • A data controller: a natural or legal person who determines the purposes and means of processing;
  • "User": any individual or legal entity, whether acting in a professional capacity or not, who visits or interacts in any way with ADAM MATERIAUX, LLC;

Adam Matériaux committed to protecting users’ privacy and personal data in accordance with applicable legislation (GDPR). All personal information that users provide to us through our various services—such as browsing our website, inquiries via email or phone, in-store or online purchases, electronic and/or paper forms, or verbal communications in-store—is treated with the utmost confidentiality.

Users may use our services for a variety of reasons: to purchase products on our website or in-store, to request a quote and/or price list, to confirm an order, to learn about our materials, to request the creation of their contractor profile (customer profile), to obtain estimates, to purchase products, to participate in training, and more.

In this context, our privacy policy outlines:

1. Data collected from users

Through our services, we collect users’ personal data when they use any of the following services:

  • Browsing and shopping on our website, when creating a counterparty profile (customer profile);
  • Requests made by email, by phone, when purchasing products in-store or online, via electronic and/or paper forms, or verbally in-store;
  • During training sessions;
  • Electronic scanning of the buyer's ID card at the order desk, ... ;
  • Contact information for the purchasing company;
  • Payment information.

Depending on the service used, this personal information may include: last name, first name, mailing address, business registration number, email address, phone number, etc. 

When you visit our website and purchase products, cookies—small text files—are stored in your web browser... No personal or identifying information is collected through these cookies.

By visiting or making purchases on our website, or by providing data, the user consents to the Data Controller processing and collecting, in accordance with the terms and principles set forth in this Privacy Policy, the personal data that the user provides on the Site or in connection with the services offered by ADAM MATERIAUX, for the purposes indicated below.

The user has the right to withdraw their consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent given prior to such withdrawal.

If the user does not consent to or is unable to authorize the collection or processing of their data as described in this privacy policy, they should not use our website or make purchases on it.

2. Right of Publicity

When visiting our store and facilities located at 14 Rue de L'Europe, 4280 Hannut to make a purchase and/or request a quote for products, or when participating in one of our events (training sessions, etc.), users may be recorded at any time by one of our video surveillance cameras, solely for security purposes.

By accessing our store and websites, the user acknowledges that they are being filmed and agrees to this.

3. How we use the information we collect

Your personal data will be processed by ADAM MATERIAUX in full compliance with the requirements of applicable European and local laws.

The data we collect enables us to provide, manage, and improve our services, as well as develop new ones. This data is not shared with any third parties.

3.1 Sending Promotions to Business Customers with a Business Registration Number:

For professionals with a business registration number (business customers), the data we collect allows us only to inform them of promotions in which they have expressed an interest or that may be of interest to them.

In our promotional mailings to business customers with a business registration number, the business customer may opt out of the mailing list at any time by clicking the free unsubscribe link at the bottom of the promotional message, or by contacting us via email: sylvia@adammateriaux.be or by writing to the ADAM MATERIAUX Data Protection Department: Rue de L'Europe 14, 4280 Hannut.

4. Accessing and updating data

As mentioned above, when users browse and make purchases on our website, submit requests via email or phone, make purchases in-store or remotely, submit information via electronic or paper forms or verbally in-store, or participate in training sessions, they authorize us to collect their personal information and to process or use it for specific purposes and to provide them with the requested information.

Users have certain rights regarding the processing of their personal data:

a. The right to access and review your data (Article 15 of the Regulation)

If you would like to view the data we process about you, you may exercise your right of access, and we will provide you with as complete an overview of your data as possible.

 

b. The right to rectify your data (Article 16 of the Regulation)

It may be the case that some of the information we hold about you is incorrect or out of date. You may always request that this information be corrected or updated, unless we are unsure of the authentic source of the information.

 

c. The right to request the erasure of your data (Article 17 of the Regulation)

If you believe that the processing of certain data is inappropriate, you may request that such data be deleted under certain conditions, as certain legal provisions related to our legal mandate require the use of certain personal data, without which we would no longer be able to fulfill our mandate.

 

d. The right to object to a specific use of your data (Article 21 of the Regulation)

If you object to a specific use of certain data in the context of processing based on a legitimate interest, you have the right to object. We will honor this objection, unless there is a compelling reason not to.

 

e. The right to object to the automated processing of your data (Article 21 of the Regulation)

Some data processing and procedures are carried out entirely automatically, without human intervention. If you disagree with the outcome of this fully automated procedure, you can contact us. You can request that one of our staff members review the matter or let us know why you are disputing this response.

 

f. The right to have your data transferred to a third party – Right to data portability (Article 20 of the Regulation)

You have the right to request that the personal data you have provided be transferred directly to a third party, within the limits set forth in the contract. In accordance with Article 20 of the Regulation, this transfer will be made in a structured, commonly used, and machine-readable format.

When the User exercises their right to data portability pursuant to the preceding paragraph, the User has the right to have their personal data transmitted directly from one data controller to another, where technically feasible.

The exercise of the right to data portability is without prejudice to the right to erasure. This right does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

 

g. To exercise your rights (Article 12.6 of the Regulation)

When you exercise a right, we may ask you to verify your identity to prevent someone else from exercising your rights on your behalf. We may therefore request a copy of your ID card.

5. Disclosure of data to third parties

We never share users’ personal data with any commercial third parties or partners. Under no circumstances is user data used for purposes other than those described in this statement.

6. Data Protection

We implement appropriate and necessary security measures—administrative, technical, and physical—to protect users’ personal data from accidental, unlawful, or unauthorized destruction, loss, alteration, unauthorized access, disclosure, or use.

7. Links to third-party websites and social media platforms and the data controller’s limitation of liability

Our website may contain links to websites or social media platforms operated by third parties. The data protection rules set forth in this document do not apply to these other websites or platforms under any circumstances.

Consequently, ADAM MATERIAUX is not responsible for the content of these websites or for their compliance with the law and the Regulations.

We recommend that users review the privacy policies issued by these third parties.

8. Update to Our Privacy Policy

User data will be retained for the legally required period.

Please note that this privacy policy is subject to change based on updates to our services as well as any feedback we receive from our users. This document will also be updated if data protection laws change. In the event of a substantial change, we will notify you via a prominent notice on our website and by indicating the date of the last update in the header of this document.

9. Governing Law and Jurisdiction

In the event of any dispute of any kind, the courts of Liège (Belgium) shall have exclusive jurisdiction. Belgian law shall apply to any dispute arising in connection with a service provided by ADAM MATERIAUX.
